This website is operated by Pickled Limited (also referred to as "we" or "our"). These terms of sale apply to your purchase of products via our website. By accessing and browsing this website, you agree to be bound by these terms of use. This website is available to you in order to provide information about our products and to enable you to purchase these products from us online. By accepting these terms, you confirm your acceptance of the Terms of Use.
Product Descriptions
We have made every effort to ensure the accuracy of information provided on our website, however, errors and omissions may occur. Our products have an extensive description, weight/measurement of product and a full ingredients list. If you suffer from food allergies, it is your responsibility to check the ingredients list.
We reserve the right to make changes to the content on this site at any time and without notice.
Pricing
The prices for the products listed on this site are in New Zealand dollars and include GST, but exclude delivery charges. We reserve the right to amend or rectify any errors in pricing or product description within 24 hours of being notified of it.
Website and Credit Card Security
We want you to have a safe and secure shopping experience online. All payments via our sites are processed using SSL (Secure Socket Layer) protocol, whereby sensitive information is encrypted to protect your privacy.
Ordering
An order made via our website is an offer to purchase product/s. When we receive a valid order from you, we will acknowledge by email, that we have received and are processing your order.
We take payment from you once you make an order.
Cancellation
Once your order is confirmed we are unable to change or cancel any aspects of it. Please carefully check your order details before completing payment.
Delivery
Delivery is made by NZ Post. We currently ship to New Zealand. Please ensure the delivery address and receiver’s name for your order is accurate and complete (including any business name if shipping to a work address) as we may be unable to change these details once the order has been placed. We will not take responsibility for any orders that go missing due to incorrect delivery information provided by you. Delivery to rural addresses may take longer in some areas. Delivery will be deemed to have been made when the goods arrive at the delivery point agreed with you.
You must notify us within 7 days of the dispatch date if you have not received an item.
Damaged/Faulty Items
We take every care when packing your order as many of our products are fragile. Your order will be packaged in layers of cardboard bubblewrap and corrugated cardboard to protect it on its journey. We then rely on a third party courier to deliver your order in the same condition it left our warehouse. If your order is damaged in transit, please contact us immediately. Please email us with photographic evidence and provide full details of condition/damage. Please do NOT dispose of any items until advised to by us as we are often required to return these to the courier for inspection. While this is most of the time out of our control, we do take every measure to make these situations right with the customer.
Returns
We stand by the quality of our products and we make things right if you are not satisfied with your purchase.
Risk
The risk of any loss of, or damage to, the products will pass to you on delivery.
Privacy
We are committed to protecting your privacy. We recognise that your personal information is confidential and we understand that it is important for you to know how we treat your personal information. As required by the Privacy Act 1993, we follow security procedures in the storage and disclosure of information, which you have given us, to prevent unauthorised access. We will never sell, publish, or give away your personal information to any other person or organisation unless required by law. Information obtained from website users may be collated and used for statistical purposes, but will not identify the user in any way.
Consumer Guarantees Act
Nothing in these terms and conditions will limit or affect your rights as a consumer under the Consumer Guarantees Act 1993 to the extent that such limitation or other contracting out is prohibited by that Act.
Force Majeure
We will not be responsible for any delay or failure to comply with our obligations under these terms of sale if the delay or failure arises from any cause which was beyond our reasonable control. This does not affect any of your statutory rights.
Amendments
We may amend these terms of use from time to time, so you should check and read these terms of use regularly. By continuing to use this site after any such amendment, you are deemed to have agreed to the amended terms of use.
Jurisdiction and Governing Law
These terms of use and any matters or disputes connected with this site will be governed by New Zealand laws and will be dealt with in New Zealand courts.
